Can you be absolutely sure that, on the day you die, none of your chosen beneficiaries will find themselves in any of the following circumstances
- Going through divorce ? ( and it is not unknown for an inheritance to actually cause a divorce!);
- Be in significant debt ?
- In care ?
- Be in receipt of means tested state benefit ?
- Incapable of managing their own financial affairs due to mental impairment or frailty ?
- Be a spendthrift ?!
- Addicted to alcohol or drugs;
- Be in control of a failing business;
- Doing so well that they need capital tax planning advice themselves – why pay tax over and over on the same assets passing from generation to generation?
- Be too immature to manage money (and this might be the case irrespective of age).
- Unless you can be certain that none of the above factors will ever be relevant to your family and friends, then we would suggest you should talk to us about the potential benefits of including some form of Discretionary Trust in your will.
